You may have heard about a Chapter 13 or Chapter 7 bankruptcy and already believe you know which one you need. But keep in mind these issues are very complicated. What Is Chapter 7?

Chapter 7 is part of the U.S. Bankruptcy Code enacted by Congress to give individuals, married couples or businesses in financial difficulty a fresh start. Chapter 7 bankruptcy will usually allow you to keep your house and vehicles provided you keep making your normal monthly payments to the mortgage or finance company. And all creditor harassment will stop as soon as you file.

Chapter 7 is a straight liquidation bankruptcy that allows people to discharge (and not pay) unsecured debts. Unsecured debts include many, but not all, purchases made on credit cards and many other types of debt.

Filing under Chapter 7 allows you to keep many assets and start over. In exchange, you may have to give up some assets, which will be taken by the creditors. Chapter 7 cannot help you with large purchases such as appliances, cash advances made within sixty days of the filing for bankruptcy; student loans, some types of tax debts, child support, and debts due to fraudulent acts and/or intentional torts or wrongs.

New Bankruptcy Law Change

There have been some changes in bankruptcy laws that apply to Chapter 7 bankruptcy. To qualify for it in the first place, you must have made less than or equal to the median income for people in Missouri in the past six months. You also have to go through a credit counseling course, as well as a debtor education course, before your debts may be discharged.

If you are able to file a Chapter 7 bankruptcy, Attorney Daniels will help you create schedules showing your creditors, assets, income and expenses. These schedules are signed by you and filed with the court along with a voluntary petition for bankruptcy.

Once these documents are filed, the automatic stay imposed through the Federal Bankruptcy Code immediately goes into effect. This means your creditors will be notified immediately and all harassment will immediately stop. It generally takes three to four months before the bankruptcy judge signs the discharge order and you are relieved of all dischargeable debt.
